These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and arkiTrace ("we," "us," or "our") governing your access to and use of the arkiTrace website (arkitrace.com) and our AI-powered architectural visualization platform (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
arkiTrace is an AI-powered proposal drafting and CRM platform for trade businesses. The Service reads client inquiries, drafts proposals with photorealistic renders, prices projects from your material catalog, produces production specifications, and delivers branded proposals to your inbox for your review and approval before any communication with your clients. You agree to provide accurate, current, and complete information during registration.
You are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of any unauthorized use at hi@arkitrace.com.
You must be at least 16 years old to create an account and use the Service.
"User Content" means any content you upload, submit, or transmit to the Service, including sketches, images, photographs, drawings, briefs, descriptions, and other materials.
You retain all ownership rights in your User Content. By uploading, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, store, and display your content solely for providing and improving the Service.
You represent that you own or have rights to your content, it does not infringe third-party rights, and does not violate any laws.
Subject to compliance with these Terms, you own the renders, proposals, and outputs generated by the Service from your content. You may use them for personal, commercial, and client projects.
You grant us a limited, non-exclusive license to use Generated Content for providing, improving, and promoting the Service, unless you opt out.
AI-generated content, including pricing calculations, material specifications, and production documents, may not always be accurate. You are responsible for reviewing and validating all Generated Content before sending it to clients or using it for production.
We do not guarantee that Generated Content will be unique, error-free, or suitable for production without verification.
The Service allows you to generate shareable links to proposals. These links are accessible to anyone who has the URL. You are responsible for controlling who you share these links with. Shareable links may contain renders, pricing, material specifications, and other project details. You can configure what information is included and set link expiry dates.
The Service is offered through subscription plans (Solo, Studio, and custom Teams & Enterprise plans) with different usage limits for proposals, renders, and team members. Prices are in EUR. Current pricing is available at arkitrace.com/#pricing.
Subscription fees are billed in advance on a monthly or annual basis via Stripe.
Subscriptions automatically renew unless you cancel before the renewal date. You can cancel anytime from your account settings.
Each plan includes a monthly allowance of proposals and renders. When you reach your allowance, you can upgrade to a higher plan or wait for your allowance to reset at the next billing cycle. On plans with metered overage, additional usage is billed at the overage rate for your plan at the end of the billing cycle.
We may change prices with 30 days' notice. Changes take effect at the start of the next billing period.
Subscription fees are non-refundable except as required by applicable law. Under EU consumer protection law, where it applies, you may have a 14-day right of withdrawal for online purchases. You can cancel at any time from your account settings; cancellation stops future billing, and your plan stays active until the end of the current billing period.
You may create an account to explore the Service interface without a subscription. Free accounts can browse the platform but cannot generate proposals or renders. No credit card is required for a free account.

The Service, including its design, features, software, and trademarks, is owned by arkiTrace and protected by intellectual property laws.
If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use it.
The Service may integrate with or link to third-party services. This includes analytics services (Google Analytics) and advertising measurement tools (Meta Pixel) used to improve the Service and measure marketing effectiveness. For details on what data these services collect, see our Privacy Policy. We are not responsible for the content, policies, or practices of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. AI-GENERATED CONTENT MAY CONTAIN ERRORS OR INACCURACIES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKITRACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless arkiTrace from claims arising out of your use of the Service, your User Content, or your violation of these Terms.
You may terminate your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, provisions that should survive will survive (ownership, disclaimers, indemnification, liability limitations).
These Terms are governed by the laws of Greece and applicable European Union law, including the GDPR and EU Consumer Rights Directive. Disputes shall be submitted to the competent courts of Athens, Greece.
We may modify these Terms at any time. Material changes will be communicated via the website and email. Continued use constitutes acceptance.
These Terms constitute the entire agreement. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent.
